Terms and Conditions

PLEASE NOTE THAT PARTICIPANTS IN THE PROGRAM (DEFINED BELOW) MUST REGISTER AND MAINTAIN AN ACCOUNT WITH UNDERDOG SPORTS WAGERING, LLC (“UNDERDOG”). UNDERDOG PROVIDES AN ONLINE SPORTS WAGERING PLATFORM ON THE UNDERDOG SPORTSBOOK APP AND MAY ALSO OFFER THE PLATFORM THROUGH A WEBSITE (COLLECTIVELY, THE “SITE”). PARTICIPANTS IN THE PROGRAM MUST ALSO ACCEPT THE TERMS OF USE (“TERMS”), WHICH IN TURN INCORPORATE AND APPLY TO THESE TERMS AND CONDITIONS. THESE TERMS AND CONDITIONS GOVERN AND CONTROL THE PROGRAM AND ARE CONSIDERED TO BE PART OF THE TERMS.  PLEASE NOTE THAT THESE TERMS AND CONDITIONS EXPRESSLY INCORPORATE MANDATORY BINDING ARBITRATION AND CLASS ACTION WAIVER PROVISIONS SET FORTH IN THE TERMS.

1. Description of Program
   Welcome to the Refer a Friend Program (the “Program”), where current Underdog Sportsbook customers (“referrer”) can refer new customers (“friends”) to make a first-time deposit on the Underdog Sportsbook platform and receive an amount in bonus funds per successful referral (the “Program Bonus”).

   ‍BONUS FUNDS ARE NOT EQUIVALENT TO CASH DEPOSITS. Bonus Funds are subject to playthrough requirements, time limitations, minimum wagering odds, ordering rules, and other limitations detailed in these Terms and Conditions.

2. Sponsor
   The Program is sponsored by Underdog Sports Wagering, LLC (“Underdog Sportsbook” or “Underdog” or the “Sponsor”). The terms “you” or “your” mean the referrer. Redemption of the Program is expressly conditioned upon acceptance of and compliance with these Terms and Conditions. Program participants may be required to sign paperwork issued by the Sponsor.
   
   Sponsor expressly reserves the right to amend, suspend or terminate this Program at any time without prior notice or consent. Administration of this Program is at the sole discretion of the Sponsor.
   
   As used in these Terms and Conditions, the “Program Advertisement” means the description of the Program presented to the referrer at the time immediately prior to entering the Program or with the code presented to the referrer and used to enter the Program, which may include but is not limited to, an advertisement on television, radio, podcast, social media, by email or direct communication on the Site or otherwise, a website or web browser, within the Underdog Sportsbook app (whether on Android, iOS, or otherwise), or in any other manner of presentment. Underdog expressly reserves the right to present different awards to referrers in its sole discretion, for any reason whatsoever, including based upon the manner described in the Program Advertisement.

3. Program Period
   The Program is valid during the time period as conspicuously stated in the Program Advertisement (the “Program Period”). Referrers must refer friend(s) during the Program Period and friend(s) must successfully make a first-time deposit of at least the amount conspicuously stated in the Program Advertisement on the Underdog Sportsbook platform after creating an Underdog Sportsbook account using the referrer’s referral code. Referrers will receive the Program Bonus in their account within 2 days of a friend making a successful first-time deposit that meets all of the requirements. Friends may email Underdog Sportsbook Customer Support (support@underdogsports.com) within 12 hours of making a deposit to retroactively apply the referrer’s referral code.
   
   
4. Eligibility
   In addition to other requirements set forth in these Terms and Conditions or the Terms, the Program is only open to individuals who are (i) verified users of the Site; (ii) at least 21 years of age; (iii) physically present in North Carolina; and (iv) not enrolled in any self-exclusion program, or otherwise prohibited from wagering in North Carolina, during the Program Period. If your social security number is associated with more than one Underdog Sportsbook account in the Sponsor’s database, you may only participate via one account. Employees, officers, directors, and other key persons of the Sponsor and its parent companies are not eligible to participate in the Program.
   
   You may only earn one Program Bonus for each friend. Additionally, Underdog reserves the right to refuse or otherwise restrict your eligibility to participate in any program, including this Program, for any reason, in its sole discretion, including based on your wagering patterns or wagering history or if you failed to act in good faith in relation to any previous program or service on the Site. This Program is void where prohibited by law. Participation in the Program is exclusive of and may make the user ineligible for other programs that Underdog may offer at the same time as the Program.
   
   The invitation to participate in this Program is not transferable. If you were not directly invited to participate in this Program by the Sponsor, you are not eligible to participate in this Program or receive any Program Bonus.
   
   Any questions relating to eligibility, these Terms and Conditions, the Terms, or any other questions concerning this Program should be directed to support@underdogsports.com.  All questions will be resolved at the sole discretion of the Sponsor and its decisions will be final and binding with respect thereto.
   
   Any referrer who is found to be ineligible to play on the Site immediately forfeits any Program Bonus, and any other award or offer associated with the Program.
   

5. How to Participate
   Eligible Underdog Sportsbook customers can refer a friend who does not have an existing Underdog Sportsbook account to create an Underdog Sportsbook account and make a first-time deposit of at least the amount conspicuously stated in the Program Advertisement on the Underdog Sportsbook platform. Upon a friend entering the referrer’s Underdog Sportsbook username as the referral code when creating a new Underdog Sportsbook account and making a successful deposit of at least the minimum amount, the referrer will receive the Program Bonus in their account. The referrer may not withdraw the Program Bonus until the full amount of the Program Bonus has been wagered on the Underdog Sportsbook platform. Referrer will be given the Program Bonus within 2 days each friend makes their first-time deposit.
   
   Friends may email Underdog Sportsbook Customer Support (support@underdogfantasy.com) within 12 hours of making a deposit to retroactively apply the referrer’s referral code.

6. Registration Procedures
   To qualify for the Program, you must have an active Underdog Sportsbook account. If you have received an invitation to participate in or been presented with the Program Advertisement during the Program Period, start referring friends by sharing your referral code. Friends must successfully create an Underdog Sportsbook account and make a first-time deposit that meets minimum requirements within the Program Period, among other requirements set forth in these Terms and Conditions and the applicable Program Advertisement (collectively, the “Program Requirements”).
   
   
7. Claiming Program Offer
   Upon successfully referring a friend who meets the Program Requirements, the Program Bonus will be credited to your Underdog Sportsbook account.
   
   Program Bonus recipients will be solely responsible for all federal, state, and local taxes, and for any other fees or costs associated with the Program Bonus received, regardless of whether the Program Bonus, in whole or in part, is used. The Program Bonus value may be reported for tax purposes as required by law. The Program Bonus is not transferable and cannot be substituted except in the Sponsor’s sole discretion. Underdog reserves the right to withhold any winnings, as required by applicable law.
   

8. Registration Procedures
   To qualify for the Program, you must have an active Underdog Sportsbook account and verify your identity in accordance with the Terms in order to play on the Site. You can create an Underdog Sportsbook account on the Underdog Sportsbook app. Creating an Underdog Sportsbook account is free.
   
   
9. Bonus Staking Rules
   With bonus funds, the stake is not returned in the payout. Only the winnings are returned in the payout. Bonus funds will not be automatically applied by default although you will have the option to choose whether to spend bonus funds or cash for entries. Bonus funds may not be used with other tokens. A wager cannot be funded using multiple sources of funds simultaneously.  

10. Bonus Funds’ Expiration
    Unless otherwise stated, any unused bonus funds will be withdrawn from your Underdog Sportsbook account 14 days after being credited.
    

11. Restrictions on Withdrawal
    The Program Bonus is not transferable and cannot be substituted except in the Sponsor’s sole discretion.
    

12. Cancellation
    Should you wish to cancel your participation in this Program at any time, please contact customer support at support@underdogsports.com. Upon cancellation, you may withdraw any funds you have deposited into your Underdog Sportsbook account without restriction. However, any bonus funds in your account are non-withdrawable. Sponsor reserves the right to decline to cancel participation in the Program in its sole discretion.
    
    
13. Gambling Problem

    Underdog offers the options to set responsible limits. If, at any point, you think you are depositing too much money, placing too many wagers, or spending too much on sports wagering, you have the option of setting responsible gaming limits. Setting responsible gaming limits allows you to still play, however, within the parameters that you set for yourself. Underdog also provides customers the ability to self-exclude directly from the product. Underdog offers the following exclusion periods: 1 year; 3 years; 5 years; and Lifetime, which permanently excludes a customer from the product. You may also terminate your account at any time. 14. Publicity
    Except where prohibited by law, by participating in the Program, the winner of a wager in which the Program was applied hereby grants Sponsor and its representatives an irrevocable, perpetual, worldwide, royalty-free, non-exclusive and sub-licensable right and license to use, distribute, and publicly display the winner’s name, the contents of any posts, and information about the Program and winnings, in any way, at any time, in any and all media, including without limitation, for use in advertising and marketing, without any additional approval or consideration. By accepting winnings associated with this Program, the winner represents and warrants that he or she has the right to grant the foregoing license.

15. Additional Terms
    
    • Damages:  Sponsor may actively seek damages from any person acting in bad faith to undermine the legitimate function of the Program to the fullest extent permitted by law. You may be disqualified from the Program if you violate these Terms and Conditions or our Terms.
      
      
    • Waiver:  Sponsor’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.
      
      
    • Other Governing Terms: Nothing herein replaces, amends, or alters the Terms or Privacy Policy governing participation in the Underdog Sportsbook and use of the Site.

    • ‍DISPUTE RESOLUTION; ARBITRATION: Section 18 of the Terms (Binding Arbitration Agreement and Class Action Waiver Agreement) is incorporated herein by reference with the same force and effect as though fully set forth herein. By agreeing to these Terms and Conditions, you agree to be bound by Section 18 of the Terms.
